Welcome to k28k! These Terms and Conditions govern your use of our services, including hosting, domain registration and design services. By using our services, you agree to be bound by these terms. Please read them carefully.

1. Definitions

  • “We,” “us,” “our,” refers to k28k.
  • “You,” “Client” refers to the user or individual accessing our services.
  • “Services” refers to all services provided by k28k, including but not limited to hosting, domain registration and web design.

2. General Terms

  • Acceptance of Terms: By accessing or using our services, you agree to comply with these Terms and Conditions, as well as any other agreements or guidelines that may apply to specific services.
  • Modifications: We reserve the right to update or modify these terms at any time. Changes will be posted on our website and continued use of our services constitutes acceptance of such changes.

3. Hosting Services

  • Service Provision: k28k provides website hosting services using shared servers. Our hosting services include basic maintenance, server uptime monitoring and technical support.
  • Uptime Guarantee: We strive to maintain a 99.9% uptime for our hosting services. However, we are not responsible for any downtime caused by factors beyond our control, such as hardware failures, network issues, or scheduled maintenance.
  • Prohibited Use: You may not use our hosting services for:
    • Storing, distributing, or transmitting illegal, infringing, or harmful content.
    • Engaging in activities that could harm the server or disrupt other users.
    • Hosting websites or applications that promote or facilitate hacking, spam, or phishing activities.
  • Backup Policy: While we offer daily backups as part of our hosting service, we strongly recommend that clients maintain their own backups. We are not responsible for data loss or corruption that occurs outside of our control.

4. Domain Registration

  • Registration Services: k28k offers domain registration services as an intermediary with domain registrars. The availability of a domain name is determined at the time of purchase and is not guaranteed until registration is complete.
  • Ownership: You retain ownership of any domains registered through our services. It is your responsibility to ensure timely renewal of domain registrations to avoid loss of domain ownership.
  • Renewals and Expiration: We will notify you of upcoming renewals before your domain registration expires. Failure to renew before the expiration date may result in loss of the domain, and k28k is not liable for such occurrences.
  • Transfers: You may transfer domain registrations to another registrar at any time, provided your account is in good standing. Transfer fees may apply as per the domain registrar’s policies.

5. Design Services

  • Scope of Work: k28k offers web design services, including but not limited to website layout, graphics and content integration. A detailed scope of work will be agreed upon prior to the commencement of any project.
  • Client Responsibilities: You are responsible for providing all necessary content, including text, images and other media, unless otherwise agreed. All content must comply with applicable laws and should not infringe the intellectual property rights of any third party.
  • Design Revisions: Our design services include a 2 or 3 rounds of revisions as part of the quoted price. Additional revisions may incur additional charges, which will be discussed and agreed upon in advance.
  • Payment Terms: A 50% deposit is required before the design project begins, with the remaining balance due upon project completion. Any delays in payment may delay project delivery.
  • Ownership of Work: Upon full payment, you will own the rights to the design work created specifically for you. k28k reserves the right to showcase completed projects in our portfolio.

6. Payment Terms

  • Fees: Fees for all services are outlined in your service agreement or invoice. Payments are due as specified in the invoice. Late payments may incur a late fee of 1.5% per month. The fee is applied after 30 days of late payment.
  • Subscription Services: Hosting and domain services are billed on a subscription basis (monthly or annually). Payments are automatically processed unless canceled before the next billing cycle.
  • Refund Policy: Refunds for hosting services are available within [30] days of initial purchase. Domain registrations, transfers, and design services are non-refundable once they have commenced.
  • Payment Methods: We accept payments via [credit card, PayPal, bank transfer, etc.]. All payments are processed securely, and we do not store payment information on our servers.

7. Termination of Services

  • Termination by You: You may terminate your services at any time by providing written notice to us. Termination does not absolve you of any outstanding fees.
  • Termination of a Domain: If you wish to cancel your domain registration, you can log into your cp.k28k.co control panel, before the domain renewal date. It is your responsibility to cancel your domain in good time if you do not want it to automatically renew. Failure to provide notice within this time frame will result in automatic renewal of the domain and you will be responsible for any associated renewal fees.
  • Termination by Us: We reserve the right to terminate or suspend your account if you breach these terms or engage in activities that harm our services or other users.
  • Effect of Termination: Upon termination, access to hosting services, domain management and any other ongoing services will be immediately revoked. It is your responsibility to back up any data before termination.
  • Domain Expiry and Deletion: If a domain registration is not renewed, it will expire and may eventually be released back into the public domain pool. You acknowledge that once a domain has expired, it may no longer be recoverable, and k28k is not liable for any loss resulting from the expiration or deletion of a domain.

8. Limitation of Liability

  • k28k is not liable for any direct, indirect, incidental, or consequential damages that may arise from the use or inability to use our services, including but not limited to loss of data, profits, or business interruption.
  • Our total liability for any claim related to our services is limited to the amount paid by you for the services in the [12] months preceding the claim.

9. Intellectual Property

  • All content and materials provided through our website, excluding user content, are the intellectual property of k28k or our licensors. You may not copy, distribute, or reproduce any part of our website without our written consent.

10. Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
